This Acceptable Use Policy (the "AUP") governs your use of the services provided by Shako Statistics LLC ("Shako Stats") at https://shakostats.com (the "Service"). The AUP is incorporated into the Terms of Service by reference. Capitalized terms not defined here have the meanings given in the Terms of Service.
We may update this AUP from time to time without re-acceptance. Changes take effect on posting. The current version is always available at this URL.
1. Prohibited Conduct
You and your Authorized Users may not, and may not permit any third party to, use the Service to:
1.1 Violate Law or Third-Party Rights
- Engage in any activity that violates applicable law, regulation, or third-party right;
- Infringe or misappropriate any patent, copyright, trademark, trade secret, right of publicity, or other intellectual property right;
- Defame, harass, threaten, or invade the privacy of any person;
- Engage in fraud, deception, or unfair business practices.
1.2 Abuse Personal Data
- Upload Customer Data containing personal information of any person without first obtaining all consents and authorizations required by law (including U.S. state privacy laws, GDPR, and CAN-SPAM);
- Upload sensitive personal information (such as government identifiers, payment card numbers, health information, or precise geolocation data of identified individuals) to the Service;
- Use the Service to re-identify, target, profile, or harm any individual;
- Sell, license, or transfer Customer Data containing personal information to a third party in violation of any consent obtained from the individuals to whom that data relates.
1.3 Compromise Security or Integrity
- Attempt to gain unauthorized access to the Service, other accounts, or any system, network, or data;
- Probe, scan, or test for vulnerabilities, or breach any security or authentication measures, except under a written authorized security testing agreement with us;
- Introduce malware, viruses, ransomware, worms, Trojan horses, or any other malicious or destructive code;
- Interfere with or disrupt the Service, servers, or networks, including through denial-of-service attacks, load testing, or excessive automated requests.
1.4 Misuse the Service
- Reverse engineer, decompile, disassemble, or attempt to derive the source code, models, or algorithms underlying the Service, except to the extent expressly permitted by law;
- Scrape, crawl, data-mine, or use any automated means to extract data from the Service, except through documented APIs in accordance with rate limits and terms;
- Use the Service to develop, train, or benchmark a competing product or service, or to provide services that compete with Shako Stats;
- Resell, sublicense, lease, time-share, or make the Service available to any third party other than your Authorized Users;
- Remove, alter, or obscure any proprietary notice, copyright, trademark, or branding;
- Frame, mirror, deep-link, or embed the Service except as expressly permitted in writing.
1.5 Misrepresent Identity or Authority
- Impersonate any person or organization, or misrepresent your affiliation;
- Use the Service in a manner that creates a misleading impression of who you are, who you represent, or whether you are acting on behalf of Shako Stats;
- Create accounts using automated means or false information.
1.6 Violate Export and Sanctions Laws
- Use the Service in violation of U.S. export control or sanctions laws (including OFAC sanctions, the Export Administration Regulations, and the International Traffic in Arms Regulations);
- Make the Service available to any individual or organization on a U.S. government denied-party list or located in a comprehensively sanctioned country.
2. Customer Data Hygiene
In addition to Section 1.2 above, when uploading Customer Data:
- Hash or pseudonymize personal identifiers (email addresses, customer IDs, addresses) before upload. The Service is designed for aggregated marketing performance data; it is not designed as a system of record for personal information.
- Do not upload raw payment card numbers, government identifiers, health information, or biometric data. These categories are out of scope for the Service.
- Maintain your own backups. We use commercially reasonable practices but you are responsible for the integrity of your source data.
3. Reporting and Enforcement
3.1 Reporting
If you become aware of a violation of this AUP — including unauthorized access to your Account, abuse of the Service, or content uploaded by another user that violates this AUP — please report it to info@shakostats.com.
3.2 Investigation
We may investigate suspected violations and may, with or without notice, access, review, or remove content; suspend or terminate accounts; and cooperate with law enforcement. We have no obligation to monitor use of the Service, but we reserve the right to do so.
3.3 Consequences
Violations of this AUP may result in:
- A warning or required corrective action;
- Temporary or permanent suspension of your Account;
- Termination of your access to the Service under the Terms of Service;
- Legal action, including injunctive relief and damages;
- Referral to law enforcement.
We are not liable for any action taken in good faith in response to a violation or suspected violation of this AUP.
